lik-sang logoLet this be a lesson for those who intend to import Sony handhelds and consoles into the UK or European Economic Area (EEA) without the express consent of Sony. Online Asian electronics distributor Lik-Sang was found to be in breach of intellectual property rights for offering Japanese PSPs to European consumers.

The justification of Lik-Sang was that its operation was well within the boundaries of law as the company is based in Hong Kong, and does not physically have a trading presence in the EEA or UK. However, presiding Judge Michael Fysh held for plaintiff Sony, finding that, " The acts of which the complainant is made have, in my view, been perpetrated not in Hong Kong but here in the EEA, and without Sony's consent."

While Sony kept mum about the case, a company spokesperson did tell G.I.biz that they will not hesitate to fully utilize the protection granted to them by law with regard to the issue of grey importing. More than just the sale of their consoles and handhelds, what they are ultimately protecting is the consumers. They don't want people to be getting hardware that did not pass the strict EU or UK consumer safety standards. And there are, in fact, a lot of factors to consider, such as the voltage supply differences, the backwards compatibility of the softwares, and the warranty coverage.

The warning comes particularly strong in light of the upcoming release of the PlayStation 3 in the U. S. and Japan. They anticipate that European consumers would want to grab a hold of the next-gen consoles as soon as possible, given that the PAL release has been delayed for another four months.

Says Sony's unnamed spokesperson, "The law is clear; grey importing PS2, PSP or PS3 into the EU, without the express permission of SCE is illegal. Therefore, we will utilize the full scope of the law to put a stop to any retailers who chose to do this."

That's tough.

 » My PSP is imported

I got mine well before the European release because Sony did the same with the PSP as they are going to with the PS3.

Of course, according to Sony, most european customers will pay through the nose for their hardware, even if it's 4 months late.

Yay sony.

 » No-Way

If sony are wanting to get consumers against them and have them boycot their products they are going the right way about it.

Why should I have to wait and then pay more for my product than people elsewhere?

There is now zero chance of me buying a PS3 (I probably wouldn't have imported one but I hate being dictated to)

My PSP was importeed too. *****ing stupid Sony. They think they can do anything they want. You know the exploding laptop batteries in Dell and Macbooks? The batteries were produced by Sony. They kept pretty quite about that didn't they? They keep cases like this quite because they know it is bad publicity and it will lose them ALOT of sales and manufacturing deals.

 » Ouch...

I don't live in Europe, but wow... thats wac...

Maybe they'll get the hint, that they should release everything at the same time... and this really wouldn't be much of a problem, esp if games are region-free.

think about it. if some dumb european bought the system and ended up blowing the goddayem thing, sony's ass would be in trouble. why? the buyer would deny how they got a system that was MEANT to be played over in japan. lik-sang would be let off the hook, scott-free. sony would be going through some dumb litigations and would be under even more pressure with another lawsuit. wouldn't it be better to prevent that from happening in the first place? you morons need to THINK before you shout out random comments and thinking you know anything LOGICAL about the business.

also, why are PAL mofos dealing with an NTFS system anyway?

i'mma eat your children!

» It was PSPs not PS3s

The lawsuit was filed in relation to Lik-Sang selling PSPs. PSPs are universal and do not use an NTSC or PAL or SECAM set up. Read carefully please?

Dork.

» Chalk up another reason why Sony is ready to fail

Here we go again. Another mistake by Sony. They just basically said no to customers buying their products. Not smart.

Also to Mike...if someone blows the thing then Lik-Sang should get off scott free. They aren't the ones that are purchasing it to use it wrong. It isn't Sony's fault either...it is the customer's fault. Liek a gun, if someone buys one and passes the background check...then goes out and shoots someone, they go to jail. not the gun shop owner or the president of the gun manufacter.

 » Crap

I was living in Tokyo and bought my PSP half a year before it was available in EU/Australia/etc. I'm now living in London and will not wait the designated time for a PS3. If I cannot secure one before the official launch here (which will be £425!! are they kidding?!) I will refuse to get one outright and will sit on the sidelines on this console war, playing my PC instead (NO Wii is not a f%^& option).

 » Typical $ony.

And people wonder why $ony are starting to go down the sh*tter. Crap like this against importing consoles like we have always done in the UK is the pits. I'm starting to actually hope the PS3 crashes and burns and $ony get the kick up the arse they need.

is an original jap import from lik sang. it has yet to let me down yet i hear plenty of stories about faulty psp's of higher model numbers. this is typical sony strongarm tactics and they stink even more now than before. if i was going for a ps3 i sure as hell wouldnt be paying the super inflated bullsh*t prices we get and now we wont have a choice lest some other company does the same thing and screws over sony. also the judge should be shot for agreeing with sony (or did some cash find its way onto his desk i wonder) - the argument is total bullsh*t, everything except the warranty. i now hope sony goes bust - they deserve no less for the arrogance they are showing. sorry for the lanuage but the more i hear the angrier i get.

 » teh suck :(

I need a JP or US PS3, so that I can get my BluRay anime fix, once the distributors make the switch from DVD. European anime-distributors are too slow and don't release nearly as many titles as region 1 distributors.

As for voltage and NTSC concerns: adapters make the world go around.

Sony can only delay the inevitable. I'll smuggle a PS3 with my anus, if I have to!

Oh yea, I'll swing that way for the PS3!!!

 » Wow

Nearly every one of these comments blasts Sony. Who was the criminal here after all???

There was a trial. Both sides presented their cases. The ruling was in favor of Sony. Get over it. Lik Sang was doing something illegal and got busted. End of discussion.

Uh, it's called a grey market for a reason, kiddies.

   Re: Idiot (Unregistered) - 2006-10-20
 » Grey market?

it's called grey market because it's not as easy as black and white you idiot. If it was, it'd be an open shut case but since it is a GREY market it's not easy to say who is in the right, Lik-Sang was acting WITHIN their boundaries, by your view, if you own a product not yet avaliable in whereever you travel, you are therefore IMPORTING it to that country and by your "grey market" type ideal, you're doing something illegal.

Learn the law retard

i dont see what is wrong with importing we are still paying for the product but i suppose its not legal if europe wasnt getting screwed in every way possible

Wouldnt sony gain more profet if Liksan bought ps2s or whatever from sony, then sold them....

 » Sony will lose

I bought a Japanese PS2 just for ONE import game. Yet they ignore things like this and all it results in is a stranglehold of their customers.

Sony are way too confident in themselves and need to realise that consumers are not dumb machines and are getting more and more irate at this kind of thing.

My sister works for SONY EU and they are so arrogant, she told me one day that PSP boxes are large (like near DVD size) because her bosses said "people like to think they are getting more for their money"

That's the honest truth and goes to show the kind of approach they have now. Idiots. maybe if UMDs DID come in smaller boxes you could carry around then retailers might be more willing to fill up shelf space with them. Fools.

 » bad SONY europe!!!

if SONY wanted to stop import/export why is it that only UK (then eventually EU) get blocked but not USA and JAPAN?... how comes you can buy USA games etc. in JAPAN and JAP games etc. in USA...

SONY Europe dont half talk CRAP reasons!!! just admit were being ripped off, you already said the UK is gonna pay more than the rest of the EU...

you've already lost me as a PS3 customer... and any other product you wish to selll...

then i'm a criminal, i imported a japanese PSP!!!
ohh my god!!!..... ¬_¬ stupid sony

   by Byte (Unregistered) - 2006-10-19
 » Slowly but surely...

...you won't have any rights left as a consumer. Technically they can now sell the same PSP for $399 in the US and EUR 799 in Europe a full year later and there is NOTHING you can do. You'll have to sit up and play nice and maybe they'll throw you a bone. Someday. Don't even THINK about getting the bone yourself.

 » Sony is a f*****g butthead

The company can get screwed if they have to put these cr**py import restictions on us all. Us good people in the UK wind up having to pay so much more money for PS3 than most everyone and not being able to obtain Japanese PSPs by import.
